Novas taxas do USCIS a partir de 2024
O Serviço de Cidadania e Imigração dos Estados Unidos (USCIS, na sigla em inglês) divulgou uma regra final, em 30 de janeiro de 2024, ajustando as taxas de benefícios imigratórios e de naturalização pela primeira vez desde 2016. A atualização dos valores, segundo o órgão, visa melhorar o financiamento operacional do USCIS, facilitando o processamento mais eficiente de pedidos.
As novas taxas do USCIS entram em vigor em 1º de abril de 2024.
No final de dezembro do ano passado, o USCIS já havia aumentado as taxas referentes ao premium processing, que começam a valer a partir de 26 de fevereiro de 2024. Em março de 2023, por sua vez, o Departamento de Estado decidiu aumentar o valor da taxa consular (MRV) dos vistos americanos.

“Pela primeira vez em mais de sete anos, o USCIS está atualizando nossas taxas para atender melhor às necessidades de nossa agência, nos permitindo fornecer decisões mais pontuais para aqueles a quem servimos”, disse Ur M. Jaddou, diretor do USCIS, em comunicado publicado no site da agência.
Além de alterar as taxas imigratórios, a nova regra do USCIS também modificou o premium processing, que agora terá seus prazos contados em dias uteis e não mais em dias corridos.

Pontos Importantes
Observe que o USCIS está implementando taxas diferentes para um mesmo formulário, dependendo do tipo de visto, incluindo H-1B, L-1 e outros, por exemplo, no caso do Formulário I-129. A taxa de petição H-1B vai sofrer um aumento substancial de US$ 460 para US$ 780 (70%). Da mesma forma, o valor da taxa de petição do visto L-1 ficará 201% mais caro, saltando de US$ 460 para US$ 1.385. Vale ressaltar que certos empregadores pequenos e organizações sem fins lucrativos podem se qualificar para taxas reduzidas.
A nova tabela de taxas do USCIS também traz mudanças importantes nas taxas do visto EB-5. A nova taxa para o Formulário I-526 e o Formulário I-526E (Petição de Imigrante por Empresário Estrangeiro/Individual e Investidor Regional) será de US$ 11.160 – 204% mais cara do que os atuais US$ 3.675. Além disso, a taxa do Formulário I-829 (Petição para o Investidor Remover Condições sobre o Status de Residente Permanente) está será agora de $9,525 (148% mais cara), especialmente para aqueles que necessitam de biometria.
Empregadores que patrocinam trabalhadores estrangeiros devem considerar o impacto orçamentário das novas taxas do USCIS ao definir seus planos de contratação.
Os solicitantes de ajuste de status pagarão metade da taxa padrão do Formulário I-765 (Pedido de Autorização de Trabalho), ou seja, apenas U$S 260, caso enviem o I-765 junto com o Formulário I-485 (Ajuste de Status).
Contexto e Revisão da Taxas
A revisão das taxas do USCIS é exigida por lei e se iniciou com uma proposta divulgada em janeiro de 2023. O órgão identificou uma deficiência significativa na estrutura atual de taxas, impactando a capacidade da agência de cobrir custos operacionais, incluindo a expansão de programas humanitários, aumentos salariais obrigatórios, aumento de pessoal e investimentos cruciais.
“Apesar de anos de financiamento inadequado, a força de trabalho do USCIS fez grandes avanços no atendimento ao cliente, redução de backlog, implementação de novos processos e programas, e na manutenção da equidade, integridade e respeito por todos a quem servimos”, acrescentou o Diretor Jaddou.

Feedback da sociedade
Depois de divulgar sua proposta de ajuste em 2023, o USCIS recebeu mais de 5,4 mil comentários públicos em resposta. A regra final publicada agora em janeiro reflete essas considerações e feedbacks. Mudanças significativas em relação à proposta original incluem:
- Redução em US$ 727 milhões na recuperação dos custos anuais da agência, em parte considerando os efeitos de medidas aprimoradas de eficiência orçamentária.
- Expansão das isenções de taxa para grupos específicos, como Menores Imigrantes Especiais (Special Immigrant Juveniles), vítimas de tráfico humano, crimes e violência doméstica; membros do serviço militar dos EUA; afegãos; e famílias que buscam adoção internacional.
- Introdução de descontos especiais para organizações sem fins lucrativos e empregadores de pequenas empresas.
- Taxas reduzidas para pedidos de Documento de Autorização de Emprego (EAD), também conhecido como work permit, em situações específicas.
- Expansão da elegibilidade para taxas reduzidas em pedidos de naturalização com base na renda familiar.
Implementação e Período de Carência
As novas taxas descritas na regra final entrarão em vigor em 1º de abril de 2024. O USCIS incentiva as partes interessadas a visitarem a página de Perguntas Frequentes em seu site para uma lista abrangente das novas taxas e também dos novos formulários, pois alguns formulários terão uma nova edição a partir de 1º de abril de 2024.
Durante um período de carência de 1º de abril de 2024 a 3 de junho de 2024, o USCIS aceitará ambas as edições de alguns formulários, desde que o documento esteja acompanhado do valor correto da taxa.
No entanto, os formulários abaixo não terão período de carência e deverão ser enviados na nova versão a partir de 1º de abril.
